  1. Introduction

By using our website and services, you agree to comply with and be bound by the following terms and conditions. Please read these terms carefully before using our services.

  1. Services Offered

Massix Creative Agency provides web design and marketing services. The specific details of the services, including scope, pricing, and timelines, will be outlined in the project agreement or proposal provided to you.

  1. Payment Terms

Payment for our services will be as agreed upon in the project agreement or proposal. Unless otherwise specified, all services require a 50% deposit payment upfront. Final remainder of payment will be due upon completion (before final files are sent) or agreed-upon milestone schedule. Late payments will incur a late termination fee.

Any cancellations made after a service has been agreed upon and already in production, you will be charged 30% of the agreed price. This is to cover the time our team members have spent working on the project and the potential time lost.

Intellectual Property

All intellectual property rights, including but not limited to copyrights, trademarks, and trade secrets, related to the services and deliverables provided by Massix Design Ltd shall belong to Massix Design Ltd unless otherwise agreed upon in writing.

  1. Client Responsibilities

You agree to provide Massix Design Ltd with all necessary information, materials, and access required to complete the project. Delays caused by your failure to fulfill these responsibilities may result in adjustments to project timelines and costs.

  1. Confidentiality

Both parties agree to keep confidential all information exchanged during the course of the project, including but not limited to business strategies, client lists, and project details.

  1. Termination of Services

Either party may terminate the services with written notice if the other party breaches any material term or condition of these terms and fails to remedy such breach within a reasonable period. If termination proceeds, all images, photography, videos, documents and files created by Massix Design Ltd will immediately be deleted and removed from our system.

  1. Limitation of Liability

To the extent permitted by law, Massix Design Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of our services.

  1. Indemnification

You agree to indemnify and hold Massix Design Ltd harmless from any claims, damages, losses, or liabilities arising out of your use of our services or your breach of these terms and conditions.

  1. Governing Law and Jurisdiction

These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the English courts.

  1. Changes to Terms and Conditions

We reserve the right to modify these terms and conditions at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our services after the posting of changes constitutes your acceptance of the updated terms.
